COUNTY ATTORNEY (Illustrative Only)

DISTINGUISING FEATURES OF THE CLASS:  The County Attorney is the Chief Legal Counsel for the Genesee County Legislature as well as the individual County Departments in all legal proceedings, including litigation and administrative hearings; and preparing contracts, local laws, resolutions and legal opinions.  The County Attorney is a full time position under the general direction of the County Legislature and serves for a 2 year term.  Supervision is exercised over the work of the Assistant County Attorney(s) and other office staff.  The incumbent will perform all related duties as required.

TYPICAL WORK ACTIVITIES:

Serves as legal counsel for the County Legislature and department heads in the interest of the County;

Serves as legal counsel for the Self Insured Workers Compensation Plan;

Prepare local laws and ordinances, legislative resolutions and motions as requested by the County Legislature;

Attend all meetings, hearings, and trials of matters of concern to the County Legislature and the Office of County Attorney;

Designs a plan for case presentation for matters requiring litigation either in house or by outside Counsel;

Appears in court, conducts trial and follows through on all cases as necessary;

Establishes priorities, policies and procedures for the Office of the County Attorney;

The Genesee County Attorney’s Office contracts with the Department of Social Services to provide all legal services required by the Department and works closely with the Commissioner of Social Services to provide social services with initial and periodic foster care review court appearances in accordance with Sections 358a and 392 of the Social Services Law and adoption surrenders pursuant to Social Services Law Sections 382 or 384;

Advise and represent all interventions for the Adult Services division of the Department of Social Services;

Advise and represent all legal matters involving the Child Protections Services division of the Department of Social Services;

Prosecutes all juvenile delinquency and PINS petitions in Family Court;

Provide whatever additional legal services to the Department of Socials Services in accordance with Department of Social Services Regulations Section 405.4 and 80 ADM 86.

Participates in the development of county policies and procedures.

Assists Human Resources Department in development and interpretation of federal and state representation in PERB/Human Rights proceedings.

Working knowledge of Civil Service Law/guidance to Human Resources and Civil Service Department on Civil Service Law/representation in civil service hearings.

Prosecution of matters involving the supervision, modification, revocation and/or reinstatement of license to carry, possess, repair and dispose of firearms pursuant to Penal Law Section 400.00

Act as Legal Counsel for Genesee Community College.

FULL PERFORMANCE KNOWLEDGE, SKILLS, ABILITIES AND PERSONAL CHARACTERSISTICS:

Thorough knowledge of County and General Municipal Law and rules;

Thorough knowledge of laws pertaining to contracts, petitions and other legal instruments, and other aspects of general legal work including FOIL, HIPPA and SEQR.;

Thorough knowledge of the proceedings of Supreme Court, family court, administrative tribunals, commissioner’s hearings and other legal proceedings;

Thorough knowledge of parliamentary procedures and the rules of procedures of the County Legislature;

Working knowledge of public information and public relations techniques;

Ability to communicate and present effectively both orally and in writing;

Ability to reason quickly and accurately in stressful situations;

Ability to understand and interpret laws, rules and regulations in order to render an accurate legal opinion;

Civil trail experience at the County and Supreme Court levels;

Ability to establish and maintain good interpersonal working relationships;

Excellent judgement, high level of integrity, skill, efficiency and fairness are required;

Physical condition shall be commensurate with the demands of the position.

 

MINIMUN QUALIFICATIONS:

Admission to the Bar in the State of New York and five (5) years of full time experience in the practice of law, preferably with civil litigation experience.

 

SPECIAL REQUIREMENT:

Incumbents in this position are required to be residents of Genesee County at the time of appointment in accordance with Article 3 of Public Officers Law and County Law Section 500, and must maintain county residency during the length of employment.

 

SALARY RANGE:

$96,987-$122,687
