LOCAL CANDIDATES TO FILE ELECTRONICALLY WITH NYSBOE

As a result of new legislation in 2019 (A. 1641/S. 3903, signed into law on October 28, 2019) amending Election Law §§14-102 and 14-104 by removing the $1,000 filing threshold, all candidates and committees are required to file campaign financial disclosure statements with the New York State Board of Elections.  The legislation also removes language requiring local and County filers to file with County Boards of Elections.

As a result of this change, County Boards of Elections will no longer be responsible for registering candidates and their committees or for accepting campaign finance disclosures and are now directed to refer all filers to the New York State Board of Elections.

This legislation went into effect December 15, 2019

You may still have candidates or committees who qualify for an exemption from filing as outlined in Election Law §§14-124.  Beginning December 15, 2019, these candidates and committees are required to file their CF-05 Claim of Exemption form with the New York State Board of Elections.  We have attached a copy of the updated CF-05 form for reference – we note that the instructions have been updated to incorporate this change.
